Cancellation Policy
This document explains your cancellation rights in relation to contracts entered into with Mercury Vehicle Solutions t/a Carleasing-online
Please note, this policy specifically relates to cancelling Carleasing-onlines brokerage service and does not relate to your cancellation rights with the Finance Provider or the Vehicle Supplier.
1 – CANCELLATION RIGHTS – CONSUMERS
1.1 – The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Regulations”) provide a 14-day cooling-off period for some contracts for goods and services which are concluded at a distance or off premises (such as online and/or over the phone). Where the Regulations apply the contract may be cancelled without penalty and without giving any reason.
1.2 – The Regulations apply where the contract is entered into by a “consumer” within the definition of the Regulations namely: an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft, or profession. Therefore, a sole trader or a partnership is not protected under the Regulations.
1.3 – If you have entered into a contract with Carleasing-online and you are a consumer, you have 14 days after the date we confirm your order (“Cancellation Period”) within which to cancel your Order.
1.4 – We reserve the right to charge for services provided and administration costs associated with cancellation, as set out in section 1.5 below.
1.5 – The cancellation fee is proportionate to the Services which have been performed, in comparison with the full fees we would have received had the contract proceeded and we had provided our Services in full.
The broker fee of £250 + VAT (£300 inc VAT) will be retained. This reflects work undertaken up to the point of cancellation. If the fee has not been paid at the point of cancellation the £300 will become due
An additional administration fee of £200 (inc VAT) will be charged to cover the costs associated with cancelling the order, including liaison with suppliers and administrative processing.
The total amount payable will not exceed £500 (inc VAT).
1.6 – To cancel a contract, you just need to let us know that you have decided to cancel. You must include details of your full name, address and details of the Order you wish to cancel. The easiest way to do this is to email [email protected]
1.7 – You may have a separate right to cancel the Finance Agreement which is not governed by this cancellation policy. Please speak to your finance provider about this.
1.8 – Subject to the status of the order at the point of cancellation the Vehicle Supplier may also charge fees for cancellation. These are separate to Carleasing-online cancellation fee referred to in paragraph 1.5 above, and we will confirm the amount of the fees which will be charged by the Vehicle Supplier when we receive your cancellation request.
1.9 – The total amount payable within 14 days of being issued. Failure to pay timely may result in a negative affect on your credit rating
2 – CANCELLATION RIGHTS – BUSINESS
2.1 – The 14-day cancellation right does not apply to transactions conducted by a business, including a sole trader, small partnership, large partnership, limited company or a limited liability partnership.
2.2 – As a business customer, when you sign the Order Form you request Carleasing-online to commence providing the Services. You accept that as a business customer the 14-day cancellation right does not apply to you, and you shall be bound by this Cancellation Policy and our Terms and Conditions to the exclusion of those provisions applicable to consumers.
2.3 – We reserve the right to charge for services provided and administration costs associated with cancellation as per 2.5 below
2.4 – Subject to the status of the order at the point of cancellation the Vehicle Supplier may also charge fees for cancellation, especially if cancelled on day before or day of delivery. These are separate to Carleasing-onlines cancellation fees referred to in paragraph 2.3 above, and we will confirm the amount of the fees which will be charged by the Vehicle Supplier when we receive your cancellation request.
